Julie Turner—representing Market Quest after a successful patent infringement trial in the Central District of Calfiornia—just won transfer of plaintiff’s appeal from the 9th Circuit to the Federal Circuit. In a published opinion, the Ninth Circuit explained “this appeal should have been filed with the Federal Circuit. Because, however, it was filed with us, we must decide what to do with it.” Declining to adopt the Seventh Circuit’s “peek at the merits” approach to appeals that should have been brought in another circuit, the Ninth Circuit determined that it would transfer the matter to the Federal Circuit “in the interest of justice.” Click here to read the full opinion.
