Turner Boyd Wins General Exclusion Order from ITC for Simple Wishes

On April 7, 2017, the International Trade Commission (ITC) issued a General Exclusion Order (GEO), in Investigation No. 337-TA-988, in response to a Complaint filed on behalf of Simple Wishes LLC by Turner Boyd attorneys Karen Boyd, Jennifer Seraphine and Keeley Vega. The GEO prohibits from entry into the United States pumping bras used by nursing mothers that infringe certain specified claims of Simple Wishes’ U.S. Patent No. 8,323,070 for the life of that patent, irrespective of the source of those products. The ITC issues a GEO in situations where it determines that such an order is necessary to prevent circumvention of an exclusion order limited to products of named persons and/or because there is a pattern of infringing conduct and it is difficult to identify the source of the infringing products. Simple Wishes filed the complaint that led to the subject Investigation on April 5, 2016. On November 14, 2016, the Administrative Law Judge presiding over the Investigation determined that Simple Wishes had proven violations of its patent rights, and the ITC issued its Commission Opinion and General Exclusion Order on April 7, 2017.
